Legal information

Payment and payout terms

1. Basic model

Payment processing for bookings on “Elektro Camping” is carried out via Stripe Connect or the payment service provider used in each case.

The platform operator collects the rental price on the basis of a collection or debt-collection authorization granted by the landlord and pays out the landlord share to the landlord in accordance with these terms.

The landlord remains the contracting party to the rental agreement and the economic recipient of the rental price minus agreed platform commissions, openly displayed fees, refunds, chargebacks and other permissible deductions.

2. Rental price and due date

  • The amount shown in checkout as immediately due becomes due upon conclusion of the paid booking.
  • Where the platform provides an installment model, the amount and due date of the individual installments are displayed transparently before booking.
  • A standard model may, for example, provide for a down payment at booking and a remaining payment before the start of rental.
  • For short-notice bookings, the total amount may be due immediately.
  • Payments are deemed made only when the payment service provider has technically confirmed the transaction and the platform was able to assign this confirmation to the respective process. The mere display of a return, success or confirmation page after a payment dialog is not sufficient for this purpose.

3. Security deposit

  • The security deposit is processed through the platform as its own payment flow completely separate from the rental price.
  • It is not part of the rental price and is not paid out to the landlord together with the rental price.
  • The platform may manage and document security-deposit amount, due date, permitted payment methods, payment status, refund status, partial refunds, retentions and allocation to claims.
  • The security deposit becomes due no later than the time shown in checkout, in the booking confirmation or in the user account.
  • Handovers may be refused or bookings may be cancelled or suspended in accordance with the platform rules if the security deposit was not paid on time.
  • Depending on payment method and payment service provider, the security deposit may be collected as an actual payment and later refunded in whole or in part. A mere card reservation or authorization is not owed.

4. Payouts to landlords

  • Payouts to landlords are made only through the Stripe Connect setup provided by the platform and are scheduled after successful QR check-in, provided that verification, payment-service-provider review, complete booking and security-deposit payments and the absence of opposing reasons are in place.
  • The platform operator may withhold payouts as long as payment defaults, refunds, chargebacks, disputes, open claims, missing handover confirmations, verification deficits or other justified reasons stand in the way.
  • The regular landlord payout concerns exclusively the rental-price process. Released retention shares from the security deposit are forwarded to the landlord only within the separate security-deposit and claim process.

5. Referral and promo payouts

  • Where the platform offers a referral or promo program, eligible users may receive a promo payout.
  • Requirements include in particular an effective referrer allocation, technical receipt of the first due rental payment or full payment, a payout-capable account and the absence of suspected misuse, payment disputes or open counterclaims at the time of scheduling.
  • Promo payouts may be scheduled directly after the confirmed first rental payment. They remain economically reclaimable or offsettable if the basis later ceases to exist due to cancellation, refund, chargeback, misuse or other justified reasons.
  • The platform operator may suspend, reject, offset or reclaim promo payouts if the economic basis subsequently ceases to exist or misuse or risk reasons exist.
  • Promo payouts are not part of the rental price and do not create any claim by the renter or landlord under the rental agreement.

6. Permissible deductions from the landlord share

  • agreed platform commission
  • openly displayed service fees, where contractually agreed
  • Stripe or payment-service-provider fees, where contractually allocated
  • refunds, chargebacks and transfer reversals
  • open counterclaims, where legally and contractually permissible

7. Security-deposit release, partial refund and retention

  • After documented return, the security deposit is released in accordance with the contractual rules.
  • Without a claim opened in time, it is refunded automatically to the renter in whole or in part.
  • If a claim is opened in time, the platform may suspend release of the security deposit until review and decision.
  • Where a retention is justified, the platform may forward the corresponding share from the security deposit to the landlord or offset it against open claims;
  • any remaining surplus must be refunded to the renter.

8. Refunds, chargebacks and disputes

  • Refunds to renters are made in accordance with the cancellation and refund terms and according to the payment service provider used.
  • In the event of a chargeback, suspected fraud, unauthorized payment or other payment dispute, the platform operator may suspend payouts in whole or in part.
  • Where a chargeback is economically attributable to a landlord process, the platform operator is entitled to offset future payouts or demand repayment where this is legally permissible.

9. Documentation

The platform provides booking confirmations, payment receipts for the rental price, security-deposit payment receipts, refund or retention receipts and platform invoices.

Where documents relating to the rental service are generated, they must be designed so that the landlord remains recognizable as the provider of the rental service or the respective document is expressly created in the name and for the account of the landlord.

Rental price separate payment process through the platform
Security deposit separate security-deposit process through the platform
Automatic landlord payout only from the rental-price process
Security-deposit retention only through documented claim process

10. Currency, reference rates and conversion

All prices, deposits, fees, refunds, payouts and other payment amounts are internally maintained and processed on the platform in euros. Displays in other currencies are provided for user convenience and represent a converted presentation of the underlying euro amounts.

For conversions into other currencies, the platform generally uses the euro foreign exchange reference rates published by the European Central Bank. The reference rates are available on the website of the European Central Bank: ECB euro foreign exchange reference rates.

Amounts displayed in a foreign currency may differ from rates shown by other providers, search engines, banks, card schemes or payment service providers. Such differences may result in particular from different rate sources, update times, rounding, fees or payment provider conditions.

The relevant euro amount remains authoritative for technical payment processing, accounting, invoicing, deposit handling, refunds, cancellations, withholdings, commissions and payouts. A display in another currency does not create any entitlement to payment, payout or settlement at a specific foreign exchange rate.
